Legal Considerations
If a client intends to license an image for a sensitive subject usage, it is the client’s responsibility to contact the <% =CompanyLegalName %> office to notify them of all the details of the usage, request sensitive subject usage licensing permission, and to finalize the copyright usage license accordingly.
<% =CompanyLegalName %> cannot clear sensitive subject usage licenses for images that are not appropriately model and or property released. Additionally, model or property released released images require further clearances from the photographer and/or model and/or property owner to avoid potential defamation. The process to clear any needed sensitive subject usage licenses might require several days. Not all sensitive subject usages will be approved, and in some cases a model or property owner may ask for an additional fee for such usage, which will be passed along to the client as part of the copyright license fee for the sensitive subject usage.
Good judgment and common sense demand attention to humour, cultural differences, and many other variables which might be considered sensitive. This area of rights is subjective, and each client must determine for itself both the need for additional clearance and the level of risk they are comfortable with.
